Comprehensive Privacy Notice

1. IDENTITY AND ADDRESS OF THE CONTROLLER 

This privacy notice governs the processing of personal data by Buenvivir, SA de CV, commercially known as “ASHLEY FURNITURE HOMESTORE”, which we will refer to hereinafter by this name, with address at Av. Periférico de la Juventud No. 5700 Interior 1, Colonia Saucito, Chihuahua, Chihuahua, Mexico CP 31110, in its capacity as Controller, which will process the personal data that concerns you as the owner of your personal data, in order to protect your privacy and your right to informational self-determination, as provided in the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDPPP”), its Regulations and the Privacy Notice Guidelines issued by the Ministry of Economy (the “Ordinances”). 

 

2. DEFINITIONS 

For the purposes of this Notice, the definitions of the terms "Personal Data", "Sensitive Personal Data", "Days", "Processing", "Data Owner", "Controller", "Transfer", "ARCO Rights" - "Right of Access", "Right of Rectification", "Right of Cancellation", "Right of Objection"; "Cookies", as well as the other elements provided in the Notice shall have the same meaning as that attributed to them in the Legal Regulations. 

 

3. PERSONAL DATA WE COLLECT AND PROCESS

At ASHLEY FURNITURE HOMESTORE, we collect and process the following personal data:

a) Identification data: Name, surname, photograph, IFE code, and signature.

b) Video surveillance data: Photographs and/or video images (if applicable).

c) General data: Full address (home or work), email address, landline telephone number (home or office), and cell phone number. 

d) Tax information: Federal Taxpayer Registry Code, as well as your tax address and tax regime (if applicable). 

e) Data linked to bank accounts, credit and/or debit cards: Name of the account holder, account number and bank of origin, CLABE (if applicable); card number; card expiration date, card type and security code. e) Personal data from publicly accessible sources and received via consented transfers: Data from public registries, directories, social networks and other lawful sources available on the market, as well as personal data that has been shared with us by third parties to whom you have previously authorized.

g) Personal data from social networks ASHLEY FURNITURE HOMESTORE may collect and process personal data and information that you have shared on social networks (such as Facebook®, Twitter®, Linkedin®, Instagram® among others), including information that you have shared as “public”, as provided by the terms and conditions of use and the policies and statements of the same. 

The personal data described in the aforementioned paragraphs of this section are collected through:

i) the use of printed forms or documents; 

ii) the use of emails and/or 

iii) the use of publicly accessible sources and other sources available on the market. 

 

4. PURPOSES

At ASHLEY FURNITURE HOMESTORE, we process your personal data to carry out activities and procedures aimed at fulfilling the obligations arising from and derived from any commercial and/or legal relationship we establish with you. These are considered primary purposes, including:

  • Carry out video recording of activities; 

  • Manage security incidents;

Additionally, we will process your personal data for other secondary purposes, which do not give rise to or are not necessary for the legal and/or commercial relationship we establish with you, including: 

  • Contact Customer Service; 

  • Manage your purchase history and other transactions; 

  • Share your comments, suggestions, complaints and clarifications about our products; 

  • Evaluate the quality of our products using various instruments, including surveys; 

  • Implement activities aimed at promoting, maintaining and improving our products; 

  • Send notifications of offers, notices and/or advertising, promotional, commercial prospecting or marketing messages, in print and electronic media; 

  • Use the different services of their corresponding Websites; 

  • Carry out general marketing and promotional activities; 

  • Conducting statistical and market analysis, and 

  • Keep our records up to date to invite you to events.  


5. CONSENT OF THE OWNER

For the purposes of the provisions of the Ordinances, you hereby declare: that this Notice has been made known to you by ASHLEY FURNITURE HOMESTORE, prior to the collection and/or processing of your personal data, ii) that you have read, understood and agreed to the terms set forth in this Notice for the collection and processing of your property and/or financial data, and therefore, if you provide them, you will include your name and signature at the bottom of this document and/or the simplified privacy notice. The foregoing, based on articles 8 and 9 of the Federal Law on the Protection of Personal Data Held by Private Parties, as well as articles 11, 12, 14, 15, 16 of the Regulation, without prejudice to the exceptional cases provided for in articles 10 and 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, which authorize us to process your personal data and transfer them in order to comply with our obligations in legal, contractual terms, or by virtue of the legal relationship, present and/or future, that we have or may have with you. 

For the collection, processing and transfer of your personal data, which are not financial or property data, you will provide us with your tacit consent under the terms of this Notice by not objecting or opposing its content within the following 48 hours after your personal data is collected and this notice has been made available to you by different means, including publication on our website. 

 

6. TRANSFER OF DATA TO THIRD PARTIES

ASHLEY FURNITURE HOMESTORE may use your personal data to offer you promotions for other products from other companies in the ASHLEY Commercial Group, which are related to the products you have purchased or expressed interest in. This purpose is not essential for the fulfillment of the legal relationship with you, and you may object to this within a period of five days following the date on which your personal data was processed by ASHLEY FURNITURE HOMESTORE.

Third parties receiving your personal data are required by the corresponding contract to maintain the confidentiality of the personal data provided by ASHLEY FURNITURE HOMESTORE and to observe this notice.

ASHLEY FURNITURE HOMESTORE may transfer your personal data to the companies listed below:

Third Party Recipient: The parent company, subsidiary companies, affiliates or related companies of ASHLEY FURNITURE HOMESTORE. 

Purpose of the Transfer: Corporate Management and Operational Support.

National or International Transfer: National and International (as applicable)

Consent Requirement: Not because they are the same corporate group, subject to the same processes.

 

7. PROCEDURE FOR EXERCISING ARCO RIGHTS AND REVOCATION OF CONSENT

At any time, you have the right to access, rectify, and delete your personal data, as well as to object to the processing of such data or revoke your consent to the processing of such data for certain purposes—including secondary purposes—that you have previously authorized, either directly or through your legal representative.

If you decide to do so directly, you can do so through the procedures we have implemented.  To learn about these procedures, requirements, and deadlines, and to exercise the aforementioned rights, if applicable, you must send your request, in accordance with Article 29 of the Law, to the person responsible for the Personal Data Protection Department, located at Periférico de la Juventud No. 5700 Interior 1, Colonia Saucito, Chihuahua, Chihuahua, Mexico, Zip Code 31110. This request must contain the following information: Your full name, address, or other means of communication to you regarding the response to your request. Documents proving your identity—a simple printed or electronic copy of your INE voter ID card or passport, as applicable, or, where applicable, of your legal representative—a simple printed or electronic copy of your power of attorney with your handwritten signature, that of two witnesses, and the representative, along with their corresponding official identification—voter ID card or passport. A clear and precise description of the personal data for which you seek to exercise any of your ARCO rights. Any other element or document that facilitates locating your personal data.

In the case of requests for access to personal data, ASHLEY FURNITURE HOMESTORE will proceed with the delivery of your information, via electronic or printed means, upon verification of your identity or that of your legal representative, as appropriate.

In the case of requests to rectify personal data, you must also indicate the changes to be made and provide documentation supporting your request. ASHLEY FURNITURE HOMESTORE will respond within a maximum of twenty days from the date it receives your request for access, rectification, cancellation, or objection, with the determination it makes so that, if appropriate, it will be effective within fifteen days from the date it communicates its response.

In all cases, ASHLEY FURNITURE HOMESTORE will respond to you through the method you chose when submitting your request, or, if applicable, through any other means agreed upon with you. The aforementioned deadlines may be extended once for an equal period, provided the circumstances of the case justify it, as provided for in the Federal Law on the Protection of Personal Data Held by Private Parties.  

The provision of personal data will be free of charge; you will only be responsible for justified shipping costs or the cost of reproduction in copies or other formats. If you repeat a request within a period of less than twelve months, you will be responsible for covering the corresponding costs under the Federal Law on the Protection of Personal Data Held by Private Parties, unless there are substantial modifications to the privacy notice that warrant further inquiries.

If the information provided in your application is incorrect or insufficient, or if the corresponding supporting documents are missing, we may request that you provide the necessary elements or documents for processing within five days of receiving your application. You will have ten days to respond to our request, starting on the day after you receive it. If you do not respond within this period, the application will be deemed not submitted.

 

8. LIMITATION OF USE AND DISCLOSURE OF INFORMATION

ASHLEY FURNITURE HOMESTORE will retain your personal data for as long as necessary to manage the commercial and/or legal relationship with you, as well as to maintain the records required by the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and applicable commercial, administrative, and tax legislation. The personal data collected by ASHLEY FURNITURE HOMESTORE is protected by appropriate administrative, technical, and physical security measures against damage, loss, alteration, destruction, or unauthorized use, access, or processing, in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations.

You may also register with the Federal Consumer Protection Agency's Public Registry of Consumers (http://rpc.profeco.gob.mx) to avoid receiving phone calls with advertising, promotions, and/or other product offers.
